How is this allowed to happen even after his wife stated many times if anything happened to her to investigate her soon-to-be-ex-husband? How can a judge nullify a jury, and if they can, why wasn't this done in the OJ or other cases that were so obviously wrong? Thank you Judge Renn, for unleashing a killer amongst the public.
A York County judge has acquitted Joseph B. Fitzpatrick III of first-degree murder after he had been sentenced to life in prison for his wife's death.Judge Richard K. Renn granted Fitzpatrick, 42, of Chanceford Township, an acquittal on Tuesday. Renn ruled that there was not enough evidence in the case to warrant a first-degree murder charge, even though Fitzpatrick had been handed a life sentence for her death in May.York County District Atttorney Tom Kearney has appealed Renn's ruling with the Pennsylvania Superior Court.A jury had found Fitzpatrick guilty of killing his wife Annemarie in 2012. He had allegedly drowned her in a creek, before covering up the homicide to make it appear as though she died in an ATV accident on their property. His attorney Christopher Ferro pushed for Tuesday's acquittal.District Attorney Tom Kearney said in a written statement that he takes "great issue" with Renn's decision."We assert Judge Renn failed to appropriately consider the facts established pretrial and at trial, as well as erroneously applied the controlling legal standards and precedent," Kearney said. "We look forward to a thorough litigation of these issues on appeal."
