Clinton questioned by FBI as part of email probe

She spent 3.5 hours with them this morning, the investigation is coming to a conclusion.  If they are going to indict her, the Dems better hope it is before the convention so they have the opportunity to select another candidate.  At this point, I doubt she will be indicted given how hard it is to prove intent and who she is.

Trump will only have a couple of weeks left to use this as a hammer. 

I suspect the final report will be just as much as dud as the final Benhaazi report was.

Trump will not be able to mention she has charges pending or will be indicted soon, but he will still be able to question her judgment and intent for using the "homebrew" server, and I'm sure that will continue.

Will the FBI and DOJ issue a report if they don't indict?  The State Department already issued their report on this issue and they were highly critical of Clinton (words from the Washington Post).

I'm not as up-to-speed on this as much as many of you seem to be, but it's my understanding that the so-called 'top secret' and/or classified email information was retroactively categorized that way.  Am I wrong on this?

That is correct, it was retroactively categorized as classified.  This line from an article about it says it best:

None of Clinton’s emails was marked as classified during her tenure, State Department officials say, but intelligence officials say some material was clearly classified at the time. Clinton initially said she did not send or receive any classified information – a denial she later adjusted, saying that none was marked as classified at the time.

Going to add some information to this discussion. It's older but gets to the point about classified information.

Statement from the Inspectors General of the Intelligence Community and the
Department of State Regarding the Review of Former Secretary Clinton's Emails
Yesterday the Office of the Inspector General of the Intelligence Community (IC IG} sent a
congressional notification to intelligence oversight committees updating them of the IC IG
support to the State Department IG.
The IC IG found four emails containing classified IC-derived information in a limited sample of
40 emails of the 30,000 emails provided by former Secretary Clinton. The four emails, which
have not been released through the State FOIA process, did not contain classification markings
and/or dissemination controls. These emails were not retroactively classified by the State
Department; rather these emails contained classified information when they were generated
and, according to IC classification officials, that information remains classified today. This
classified information should never have been transmitted via an unclassified personal system.

These weren’t just ordinary secrets found in Clinton’s private server, but some of the most classified material the U.S. government has.

After months of denials and delaying actions, Hillary Clinton has decided to turn over her private email server to the Department of Justice. As this controversy has grown since the spring, Clinton and her campaign operatives have repeatedly denied that she had placed classified information in her personal email while serving as secretary of state during President Obama’s first term. (“I am confident that I never sent nor received any information that was classified at the time it was sent and received,” she said last month.) Her team also denied that she would ever hand over her server to investigators. Now both those assertions have been overturned.

Hillary Clinton has little choice but to hand over her server to authorities since it now appears increasingly likely that someone on her staff violated federal laws regarding the handling of classified materials. On August 11, after extensive investigation, the intelligence community’s inspector general reported to Congress that it had found several violations of security policy in Clinton’s personal emails.

Most seriously, the inspector general assessed that Clinton’s emails included information that was highly classified—yet mislabeled as unclassified. Worse, the information in question should have been classified up to the level of “TOP SECRET//SI//TK//NOFORN,” according to the inspector general’s report.

TOP SECRET, as the name implies, is the highest official classification level in the U.S. government, defined as information whose unauthorized release “could cause exceptionally grave damage to national security or foreign relations.”

Thanks for the info.  Can we expect the same scrutiny applied to Colin Powell and Condoleeza Rice, or has some kind of statute of limitations run out?  Are there any others in the same boat as Clinton?

A 3 plus hour long interview with the FBI has real dangers.
Any misstatement/false statement to an FBI agent is a crime even though the party being questioned is not under oath!

Fred that comparison is apples and oranges. Powell or Rice did not set up a personal server in their basement and then put highly classified material on it. The use of the personal server also stop FOIA requests from being completed.
One last thing Clinton has repeatedly told lies over and over about this issue. A issue that occurred when she was a high level government employee.

So Clinton knew the information was highly classified at the time and put the info on a personal server?  I guess it's in the hands of the FBI now to determine wrong doing?  We shall wait and see, I guess.
