ACLU ‘Strongly’ Opposes Latest Bipartisan Effort to Ban Those on Terror Watch Lists From Purchasing Guns

While House Democrats on Capitol Hill participate in a sit-in pushing for a vote on gun control measures, the liberal-leaning American Civil Liberties Union is urging lawmakers to vote “no” on the latest proposal being considered.

The latest legislation, proposed by Sen. Susan Collins (R-Maine) and backed by Senate Minority Leader Harry Reid (D-Nev.), is a compromised version of the “terrorism watch list” firearm ban bill proposed by Democratic Sen. Diane Feinstein (Calif.) earlier this week.

The measure proposed by Collins utilizes the No-Fly list and the Selectee List as the basis for its restrictions. Though the list would offer a much narrower group of people than the broad list proposed by Feinstein, the ACLU still finds the proposal to be an “unfair watchlist system.”“The ACLU strongly urges you to vote against the Collins Amendment because it uses the error-prone and unfair watchlist system, along with vague and overbroad terms, as a predicate for a proceeding to deny a firearms permit,” officials at the ACLU wrote in a letter to lawmakers.

The ACLU believes implementing the Collins amendment would serve to “further entrench a watchlist system that is rife with problems,” adding that the current watchlist is “unreliable because it uses vague and overbroad criteria and secret evidence to place individuals on blacklists without a meaningful process to correct government error and clear their names.”The nonprofit organization also noted the fact that “nominations to the master watchlist need not be based on ‘concrete facts.’”

“It permits placement on the master watchlist based on uncorroborated or even questionably reliable information,” the ACLU added.
 


 “We hold these truths to be self-evident,”  former vice president Biden said during a campaign event in Texas on Monday. "All men and women created by — you know, you know, the thing.”

How many seconds ago did you turn from a critic of the ACLU to a fan?

We live in a time in which decent and otherwise sensible people are surrendering too easily to the hectoring of morons or extremists.

Yeah . . . Sounds to me like their problem is not with gun control legislation, but with the mechanics and management of the no-fly list and other terrorist watch lists.

As Tennyson says: "fix the problem".

Or, is that too much to ask from our elected representatives?

Apparently so . . . I hear they've checked out for a two week vacation.

In my opinion, to even consider using the either the terrorism watch list or no-fly list to deny someone their constitutional rights, they need to be transparent, accurate, clear and easily understandable criteria for inclusion on the list, and due process to be included on the list and the ability to defend yourself and appeal your inclusion.

As constituted now, I have grave and serious concerns about using these lists.

Yes, it is a case of individual rights vs the common good.
And we have decided that the common good has been trumped by the right to buy any weapon by anyone at any time, regardless of grave and serious concerns about the effect on the common good.


We live in a time in which decent and otherwise sensible people are surrendering too easily to the hectoring of morons or extremists.

This discussion about the terror watch lists isn't about the "right to buy any weapon, by anyone, at any time".  This isn't a discussion about semi-automatic rifles and if they should be for sale and this isn't a discussion about universal background checks and being able to buy guns instantly.

The use of these lists to restrict people from being able to purchase any weapon is the issue here.  And I have concerns with the government taking away that right granted by the 2nd amendment based on the current setup of these lists.

Oh my God Brady, what a ridiculous notion.  The government would never abuse such lists to keep people from buying guns, no way!  Don't you know the government is here to help us?!
